{"id":17943,"date":"2020-12-11T07:36:46","date_gmt":"2020-12-11T12:36:46","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=17943"},"modified":"2020-12-11T07:36:46","modified_gmt":"2020-12-11T12:36:46","slug":"serial-rapists-receive-longer-minimum-jail-terms-after-appeal","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2020\/12\/11\/serial-rapists-receive-longer-minimum-jail-terms-after-appeal\/","title":{"rendered":"Serial rapists receive longer minimum jail terms after appeal"},"content":{"rendered":"<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p><b class=\"css-14iz86j-BoldText e5tfeyi0\">Two serial rapists with life sentences will have the minimum time they must spend in prison extended from 30 to 40 years, the High Court has ruled.<\/b><\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Joseph McCann, 35, was jailed last year at the Old Bailey for 37 offences involving 11 women and children.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Reynhard Sinaga, 37, was sentenced at Manchester Crown Court in January for 159 offences against 48 men.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>The judges rejected calls for whole-life jail terms, never successfully imposed in a non-homicide case.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Such an order, meaning a life sentence with no minimum term, is usually reserved for certain types of murders, like those involving serial murder, child abduction or a terrorist motive.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>The attorney general referred McCann and Sinaga&#8217;s convictions to the Court of Appeal after describing their original jail terms as &#8220;unduly lenient&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"unordered-list-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<div class=\"css-1pzprxn-BulletListContainer e5tfeyi3\">\n<ul role=\"list\">\n<li><a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-beds-bucks-herts-50676721\" target=\"_blank\" rel=\"noopener noreferrer\">The failures that let Joseph McCann out of prison<\/a><\/li>\n<li><a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-50688975\" target=\"_blank\" rel=\"noopener noreferrer\">The sexual predator who waited outside nightclubs<\/a><\/li>\n<li><a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-54543447\" target=\"_blank\" rel=\"noopener noreferrer\">Serial rapists &#8216;should never be released&#8217;<\/a><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Five senior judges &#8211; including the Lord Chief Justice Lord Burnett and the President of the Queen&#8217;s Bench Division, Dame Victoria Sharp &#8211;\u00a0<a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-54543447\" target=\"_blank\" rel=\"noopener noreferrer\">heard the appeal in October at the High Court in London<\/a>.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Their judgement,\u00a0<a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/www.judiciary.uk\/wp-content\/uploads\/2020\/12\/McCann-Sinaga-Shah-judgment-111220.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">published on Friday<\/a>, says &#8220;we are thus unable to accept the submission&#8221; that two offenders should have received a whole-life tariff.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>But, they add, in the &#8220;collective experience of this court the cases of McCann and Sinaga, albeit very different on their individual facts, come within the category of the most serious cases involving a campaign of rape to have been tried in England and Wales.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>The judgement then alters the minimum terms for McCann and Sinaga to 40 years each, saying the &#8220;multiple life sentences remain and whether either is in fact ever released will depend upon the assessment of risk by the Parole Board at the end of the minimum terms&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>The ruling states that &#8220;neither man has shown any remorse and the long-term psychological damage for at least some of the victims in both trials is profound and will only be understood in the years to come&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i84\" data-component=\"crosshead-block\">\n<h2 class=\"css-1jlqpzd-StyledHeading e1fj1fc10\">Whole-life guidance<\/h2>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>The judgement says it endorses the line of authority that does &#8220;not shut the door&#8221; to a whole-life tariff in a non-murder case.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Examples it gives include a &#8220;bomb planted on a commercial airliner&#8221; that fails to explode or intervention by the authorities that &#8220;prevents an act of mass-murder&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>The offending of McCann and Sinaga, &#8220;does not, in our judgement, call for either to receive a whole-life tariff&#8221;, the ruling states.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>It adds: &#8220;This is not to minimise the seriousness of their offending but instead to ensure that the most severe sentence in our jurisdiction is reserved, save exceptionally, either for the most serious cases involving loss of life, or when a substantive plan to murder of similar seriousness is interrupted close to fulfilment.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>In a statement after the ruling, Solicitor General Michael Ellis QC said: &#8220;Both offenders carried out some of the most heinous and depraved sexual attacks that shocked the nation.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>&#8220;I am grateful for the guidance the court gave about whole-life orders and I am pleased that the court imposed a longer minimum term.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>&#8220;I hope this brings some solace to the victims of these despicable crimes.&#8221;<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Meanwhile, Greater Manchester Police said it had identified a further 23 people it believed were victims of Sinaga.
