{"id":1789,"date":"2016-10-26T16:40:17","date_gmt":"2016-10-26T20:40:17","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=1789"},"modified":"2016-10-26T16:40:17","modified_gmt":"2016-10-26T20:40:17","slug":"somalian-rapist-branded-a-danger-to-the-community-wins-human-rights-battle-to-stay-in-uk","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2016\/10\/26\/somalian-rapist-branded-a-danger-to-the-community-wins-human-rights-battle-to-stay-in-uk\/","title":{"rendered":"Somalian Rapist Branded a &#8220;danger to the community&#8221; Wins Human Rights Battle to Stay in UK"},"content":{"rendered":"<p><strong>\u00a0<\/strong><\/p>\n<p>UK &#8211; Abdalla Ali Hemed, \u00a052, came to Scotland on a false passport in 2002 but was granted indefinite leave to stay after fleeing the oppressive military regime in his home country Somalia.<\/p>\n<p>In 2004, Hemed and a gang of men subjected his first victim to serious sexual assault in a flat in Aberdeen.\u00a0At the time of the attack, he was out on bail for allegedly carrying a knife.<\/p>\n<p>In 2006, Hemed attacked another three woman. He was eventually caught and remanded in custody.\u00a0On being freed later that month he was re-arrested after trying to leave his flat with a knife later telling police he was on his way to a nearby flat to kill the person who lived there.\u00a0Hemed was convicted of breach of the peace in relation to that incident.<\/p>\n<p>In 2008 Hemed was jailed for nine years.<\/p>\n<p>The Home Secretary at the time, Theresa May, launched a legal bid to have the 52-year-old removed from Britain in 2013.<\/p>\n<p>He successfully appealed the move on human rights&#8217; grounds claiming his life would be in danger if he was forced to return to Somalia because he is from a minority ethnic group.<\/p>\n<p>The Home Office challenged that ruling but yesterday the Court of Session in Edinburgh ruled in favour of Hemed by refusing the appeal.\u00a0He was allowed to remain under Articles 2 and 3 of the European Convention on Human Rights, which guarantee the right to life and prohibit torture.<\/p>\n<p>Delivering the decision \u00a0Judge Lord Carloway stated that, &#8220;(Hemed) could not realistically be expected to relocate to Mogadishu (Somalia). There was no error of law in carrying out that exercise.
