{"id":17872,"date":"2020-11-24T06:58:13","date_gmt":"2020-11-24T11:58:13","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=17872"},"modified":"2020-11-24T06:59:02","modified_gmt":"2020-11-24T11:59:02","slug":"harry-dunns-parents-lose-high-court-immunity-review","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2020\/11\/24\/harry-dunns-parents-lose-high-court-immunity-review\/","title":{"rendered":"Harry Dunn&#8217;s parents lose High Court immunity review"},"content":{"rendered":"<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p><b class=\"css-14iz86j-BoldText e5tfeyi0\">Harry Dunn&#8217;s parents have lost their High Court battle against the Foreign Office over whether their son&#8217;s alleged killer had diplomatic immunity.<\/b><\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Mr Dunn, 19, died when his motorbike was in a crash with a car near RAF Croughton, Northamptonshire, in 2019.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>The suspect, 43-year-old Anne Sacoolas, later left for the United States citing diplomatic immunity.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Mr Dunn&#8217;s mother Charlotte Charles said the High Court ruling was &#8220;just a blip along the way&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Mrs Sacoolas, whose husband Jonathan worked as a technical assistant at the RAF base, was charged with causing death by dangerous driving in December, but an extradition request was denied in January.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>The legal challenge by Mrs Charles and Mr Dunn&#8217;s father Tim Dunn\u00a0<a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-northamptonshire-54904234\">claimed Mrs Sacoolas should not have been granted immunity<\/a>.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>But Lord Justice Flaux and Mr Justice Saini concluded &#8220;that Mrs Sacoolas enjoyed immunity from UK criminal jurisdiction at the time of Harry&#8217;s death&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-18mjolk-ComponentWrapper e1xue1i80\" data-component=\"image-block\">\n<figure class=\"css-1759m9z-StyledFigure e34k3c20\">\n<div class=\"css-kwaqyc-StyledFigureContainer e34k3c22\"><span class=\"css-1hq4gmv-Placeholder e16icw910\"><img loading=\"lazy\" decoding=\"async\" class=\"css-evoj7m-Image ee0ct7c0\" src=\"https:\/\/c.files.bbci.co.uk\/182F\/production\/_115419160_hi064297992.jpg\" srcset=\"https:\/\/ichef.bbci.co.uk\/news\/240\/cpsprodpb\/182F\/production\/_115419160_hi064297992.jpg 240w, https:\/\/ichef.bbci.co.uk\/news\/320\/cpsprodpb\/182F\/production\/_115419160_hi064297992.jpg 320w, https:\/\/ichef.bbci.co.uk\/news\/480\/cpsprodpb\/182F\/production\/_115419160_hi064297992.jpg 480w, https:\/\/ichef.bbci.co.uk\/news\/624\/cpsprodpb\/182F\/production\/_115419160_hi064297992.jpg 624w, https:\/\/ichef.bbci.co.uk\/news\/800\/cpsprodpb\/182F\/production\/_115419160_hi064297992.jpg 800w\" alt=\"Harry Dunn's parents, Charlotte Charles and Tim Dunn\" width=\"976\" height=\"549\" \/><\/span><\/div><figcaption class=\"css-1rnnz6t-StyledFigureCaption e34k3c21\">Harry Dunn&#8217;s parents, Charlotte Charles and Tim Dunn, want Mrs Sacoolas to return to the UK (Image: PA Media)<\/figcaption><\/figure>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>&nbsp;<\/p>\n<p>Mrs Charles said: &#8220;The government and Mrs Sacoolas need to understand that this court ruling is just a blip along the way.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>&#8220;I promised my boy I would get him justice and that is just what we are going to do. Northamptonshire Police&#8217;s investigation into their son&#8217;s death.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Lord Justice Flaux and Mr Justice Saini found officials had &#8220;sought to assist rather than obstruct Northamptonshire Police in their investigation&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>The family&#8217;s case centred on a 1995 agreement between the UK and the US, granting immunity to administrative and technical staff at the RAF base, which the US waived in relation to &#8220;acts performed outside the course of their duties&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Lawyers for Mr Dunn and Mrs Charles argued that the Foreign Office &#8220;took upon itself the authority to resolve the question of immunity and ultimately and unlawfully decided to accept the US embassy&#8217;s decision that Anne Sacoolas had immunity&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-mysbf6-ComponentWrapper-CrossheadComponentWrapper e1xue1i84\" data-component=\"crosshead-block\">\n<h2 class=\"css-1jlqpzd-StyledHeading e1fj1fc10\">&#8216;Cruel and needless&#8217;<\/h2>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>In written submissions, the Foreign Office argued its officials had &#8220;objected in strong terms&#8221; to Mrs Sacoolas leaving the UK, and &#8220;repeatedly emphasised&#8221; that the department &#8220;wanted the Sacoolas family to co-operate with the UK authorities&#8221;.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>Lord Justice Flaux and Mr Justice Saini ruled that Mrs Sacoolas had diplomatic immunity &#8220;on arrival in the UK&#8221; under the Vienna Convention on Diplomatic Relations.<\/p>\n<\/div>\n<\/div>\n<div class=\"css-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\">\n<div class=\"css-83cqas-RichTextContainer e5tfeyi2\">\n<p>As this had not been &#8220;expressly waived&#8221;, it meant Mrs Sacoolas &#8220;had immunity at the time of Harry&#8217;s death&#8221;
