{"id":17641,"date":"2020-09-28T06:16:00","date_gmt":"2020-09-28T10:16:00","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=17641"},"modified":"2020-09-28T06:16:00","modified_gmt":"2020-09-28T10:16:00","slug":"dreamworld-accident-australian-theme-park-fined-over-four-deaths","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2020\/09\/28\/dreamworld-accident-australian-theme-park-fined-over-four-deaths\/","title":{"rendered":"Dreamworld accident: Australian theme park fined over four deaths"},"content":{"rendered":"<p>The operator of Australia&#8217;s Dreamworld theme park has been fined A$3.6m (\u00a32m; $2.5m) over the deaths of four people on a malfunctioning water ride.<\/p>\n<p>Kate Goodchild, Luke Dorsett, Roozbeh Araghi and Cindy Low died in October 2016 when their raft crashed into another and overturned, crushing them.<\/p>\n<p>Park operator Ardent Leisure admitted in July to breaching safety laws.<\/p>\n<p>The company said it accepted responsibility and had worked to improve safety standards.<\/p>\n<p>The four victims &#8211; all adults &#8211; died almost instantly after the Thunder River Rapids Ride rafts collided, an inquiry heard in 2018. Two children were also on board but survived.<\/p>\n<p>The accident at Australia&#8217;s biggest theme park was caused by a pump that malfunctioned near the end of the ride.<\/p>\n<p>On Monday, a court said the company had failed in its duty of care and should have taken steps to make the ride safer.<\/p>\n<p>&#8220;Steps were not that complex or burdensome and only mildly inconvenient and really were inexpensive,&#8221; Magistrate Pamela Dowse said.<\/p>\n<p>&#8220;They operated the most iconic amusement park in the country, which targeted and attracted families.<\/p>\n<p>&#8220;There was complete and blind trust placed in the defendant by every guest who rode the Thunder River Rapids Ride.&#8221;<\/p>\n<div class=\"css-kwaqyc-StyledFigureContainer e34k3c22\"><span class=\"css-1hq4gmv-Placeholder e16icw910\"><img loading=\"lazy\" decoding=\"async\" class=\"css-evoj7m-Image ee0ct7c0\" src=\"https:\/\/c.files.bbci.co.uk\/4983\/production\/_113691881_sdsdsdsds.png\" srcset=\"https:\/\/ichef.bbci.co.uk\/news\/240\/cpsprodpb\/4983\/production\/_113691881_sdsdsdsds.png 240w, https:\/\/ichef.bbci.co.uk\/news\/320\/cpsprodpb\/4983\/production\/_113691881_sdsdsdsds.png 320w, https:\/\/ichef.bbci.co.uk\/news\/480\/cpsprodpb\/4983\/production\/_113691881_sdsdsdsds.png 480w, https:\/\/ichef.bbci.co.uk\/news\/624\/cpsprodpb\/4983\/production\/_113691881_sdsdsdsds.png 624w, https:\/\/ichef.bbci.co.uk\/news\/800\/cpsprodpb\/4983\/production\/_113691881_sdsdsdsds.png 800w\" alt=\"Picture from coroner's report shows one raft flipped on its side leaning against upright raft\" width=\"976\" height=\"549\" \/><\/span><\/div>\n<p>The raft carrying passengers flipped in the collision<\/p>\n<p>&nbsp;<\/p>\n<p>The size of the fine reflected the severity of the company&#8217;s failure, she added. Ardent had been facing a maximum A$4.5m fine.<\/p>\n<p>Chief executive John Osborne said: &#8220;Ardent accepts responsibility for this tragedy, and we fully accept the consequences.&#8221;<\/p>\n<p>Families of the victims also delivered statements to the sentencing court on Monday, expressing grief and anger over their loss.<\/p>\n<ul role=\"list\">\n<li><a class=\"css-yidnqd-InlineLink e1no5rhv0\" href=\"https:\/\/www.bbc.co.uk\/news\/world-australia-53576126\" target=\"_blank\" rel=\"noopener noreferrer\">Australia theme park admits guilt over ride deaths<\/a><\/li>\n<\/ul>\n<p>&#8220;That Cindy died violently is unacceptable to us,&#8221; said Helen Cook, aunt to Ms Low. &#8220;Knowing her death could have been avoided is unacceptable and infuriating.&#8221;<\/p>\n<p>In February, a coroner found the accident had been &#8220;only a matter of time&#8221; as the theme park had not properly assessed the ride&#8217;s safety risk in over 30 years.<\/p>\n<p>Dreamworld briefly shut down for six weeks after the accident in 2016, during which it demolished the ride.<\/p>\n<p>The company has reported operating losses every year since the accident, including more than A$260m in losses in its theme park division.<\/p>\n<p>It is also fighting a class action from shareholders who claim the company misled them on the park&#8217;s safety measures.<\/p>\n<p><a href=\"https:\/\/www.bbc.co.uk\/news\/world-australia-41020829\" target=\"_blank\" rel=\"noopener noreferrer\">The accident also prompted Queensland to introduce an industrial manslaughter offence in 2017.<\/a> It cannot be applied retroactively.<\/p>\n<p>Source: <a href=\"https:\/\/www.bbc.co.uk\/news\/world-australia-54321389\" target=\"_blank\" rel=\"noopener noreferrer\">bbc.co.uk<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">The operator of Australia&#8217;s Dreamworld theme park has been fined A$3.6m (\u00a32m; $2.5m) over the deaths of four people on a malfunctioning water ride.
