{"id":17248,"date":"2020-06-19T08:16:27","date_gmt":"2020-06-19T12:16:27","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=17248"},"modified":"2020-06-19T08:16:27","modified_gmt":"2020-06-19T12:16:27","slug":"michael-kovrig-and-michael-spavor-china-charges-canadians-with-spying","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2020\/06\/19\/michael-kovrig-and-michael-spavor-china-charges-canadians-with-spying\/","title":{"rendered":"Michael Kovrig and Michael Spavor: China charges Canadians with spying"},"content":{"rendered":"<p class=\"story-body__introduction\">China has charged two Canadians with spying, more than 18 months after they were detained.<\/p>\n<p>Michael Kovrig, a former diplomat, and Michael Spavor, a businessman, have been held in China since December 2018.<\/p>\n<p>Their arrests came just days after Meng Wanzhou &#8211; an executive of the Chinese giant Huawei &#8211; was detained in Vancouver, at the request of the US.<\/p>\n<p>Canada called the arrests &#8220;arbitrary&#8221;, but China denies they were retaliation for Ms Meng&#8217;s detention.<\/p>\n<p>Both men have been charged with &#8220;spying on national secrets&#8221; and providing intelligence for &#8220;outside entities&#8221;.<\/p>\n<p>China&#8217;s court system is completely controlled by the Communist Party and has an almost 100% conviction rate once defendants are charged, notes the BBC&#8217;s Stephen McDonell in Beijing.<\/p>\n<h2 class=\"story-body__crosshead\">What is the timeline?<\/h2>\n<p>Meng Wanzhou &#8211; the chief financial officer of Huawei, and daughter of the company&#8217;s founder &#8211; was arrested on 1 December 2018 in Vancouver.<\/p>\n<p>Her arrest was requested by the US, who accuse her of breaking Iranian sanctions. She is still fighting extradition to the US.<\/p>\n<p>On 10 December, the Canadians were detained in China. They were formally arrested in May 2019, after which they had 13-and-a-half months to be charged.<\/p>\n<p>In September, Canadian Prime Minister Justin Trudeau accused China of &#8220;using arbitrary detention as a tool to achieve political goals&#8221;.<\/p>\n<figure class=\"media-landscape has-caption full-width\"><span class=\"image-and-copyright-container\"><img loading=\"lazy\" decoding=\"async\" class=\"responsive-image__img js-image-replace\" src=\"https:\/\/ichef.bbci.co.uk\/news\/624\/cpsprodpb\/4FF7\/production\/_112517402_hi061578069.jpg\" alt=\"Meng Wanzhou leaves her home to attend her extradition hearing at a Vancouver court in January\" width=\"976\" height=\"549\" data-highest-encountered-width=\"624\" \/><\/span><figcaption class=\"media-caption\"><span class=\"media-caption__text\">Huawei&#8217;s Meng Wanzhou has been living in Canada under house arrest (Image: Reuters)<\/span><\/figcaption><\/figure>\n<h2><\/h2>\n<h2 class=\"story-body__crosshead\">How have they been treated?<\/h2>\n<p>Michael Kovrig&#8217;s employer, the Crisis Group think tank, says on its website that he has not seen a lawyer or his family since the detention, and that he only has &#8220;periodic consular visits&#8221;.<\/p>\n<p>&#8220;Michael&#8217;s work has included meeting&#8230;Chinese officials, academics and analysts from multiple Chinese state institutions,&#8221;\u00a0<a class=\"story-body__link-external\" href=\"https:\/\/www.crisisgroup.org\/who-we-are\/people\/michael-kovrig\" target=\"_blank\" rel=\"noopener noreferrer\">the Crisis Group said.<\/a><\/p>\n<p>&#8220;He has attended numerous conferences at the invitation of Chinese organisations. He frequently appears on Chinese television and in other media to comment on regional issues.<\/p>\n<p>&#8220;Nothing Michael does has harmed China.&#8221;<\/p>\n<p>The\u00a0<a class=\"story-body__link-external\" href=\"https:\/\/www.freemichaelspavor.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Free Michael Spavor<\/a>\u00a0website, updated earlier this year, said he was &#8220;behind bars, without his family, and without access to lawyers&#8221;.<\/p>\n<p>&#8220;Michael is an earnest, genuine, and impossibly fun person, who we believe has been detained in error,&#8221; the website says.<\/p>\n<p>In April 2019,\u00a0<a class=\"story-body__link-external\" href=\"https:\/\/www.theglobeandmail.com\/world\/article-two-canadians-detained-in-china-are-prevented-from-seeing-the-sun-or\/\" target=\"_blank\" rel=\"noopener noreferrer\">it was reported<\/a>\u00a0that both men were being interrogated for between six to eight hours a day, and were sometimes subject to 24-hour artificial lighting.<\/p>\n<p>The Chinese government says the men are in &#8220;good health&#8221;.<\/p>\n<h2 class=\"story-body__crosshead\">What is the latest with Meng Wanzhou?<\/h2>\n<p>Last month, a Canadian court ruled that her case could go forward.<\/p>\n<p>A judge found the case met the threshold of double criminality &#8211; meaning the charges would be crimes in both the US and Canada.<\/p>\n<p>Her lead defence lawyer, Richard Peck, argued that Canada was effectively being asked &#8220;to enforce US sanctions&#8221;.<\/p>\n<ul class=\"story-body__unordered-list\">\n<li class=\"story-body__list-item\"><a class=\"story-body__link\" href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-52793343\" target=\"_blank\" rel=\"noopener noreferrer\">Top Huawei executive suffers US extradition blow<\/a><\/li>\n<li class=\"story-body__list-item\"><a class=\"story-body__link\" href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-50592055\" target=\"_blank\" rel=\"noopener noreferrer\">Canadians held for a year by China are &#8216;resilient&#8217;<\/a><\/li>\n<\/ul>\n<p>A year after her arrest, Ms Weng\u00a0<a class=\"story-body__link-external\" href=\"https:\/\/www.huawei.com\/en\/facts\/voices-of-huawei\/your-warmth-is-a-beacon-that-lights-my-way-forward\" target=\"_blank\" rel=\"noopener noreferrer\">released an open letter<\/a>, detailing her life in detention at her home in Vancouver.<\/p>\n<p>&#8220;Over the past year, I have learned to face up to and accept my situation,&#8221; she said. &#8220;I&#8217;m no longer afraid of the unknown.&#8221;<\/p>\n<p>She also said she finally had time to &#8220;read a book cover to cover,&#8221; or &#8220;carefully complete an oil painting&#8221;.<\/p>\n<h2 class=\"story-body__crosshead\">China&#8217;s heavy hints over Meng Wanzhou case<\/h2>\n<figure class=\"media-landscape no-caption full-width\"><span class=\"image-and-copyright-container\"><img loading=\"lazy\" decoding=\"async\" class=\"responsive-image__img js-image-replace\" src=\"https:\/\/ichef.bbci.co.uk\/news\/624\/cpsprodpb\/15E13\/production\/_110891698_stephenmcdonell-nc.png\" alt=\"Analysis box by Stephen McDonell, China correspondent\" width=\"1706\" height=\"340\" data-highest-encountered-width=\"624\" \/><\/span><\/figure>\n<p>Though the Chinese government has not absolutely, explicitly linked the cases of Michael Spavor and Michael Kovrig with Meng Wanzhou&#8217;s extradition proceedings in Vancouver, it has certainly given large dollops of nudge, nudge, wink, wink references making this connection.<\/p>\n<p>At the foreign ministry&#8217;s regular press briefings, the various spokespeople routinely mention the fate of the Canadians and that of the daughter of Huawei&#8217;s founder in the same response, whether they&#8217;ve been prompted to do so or not by reporters.<\/p>\n<p>The Communist Party&#8217;s media outlets have been more specific. Canada: if you want this former diplomat and businessman back, you know what you have to do\u2026 release Meng Wanzhou.<\/p>\n<p>The problem, of course, is that in Canada, there is a separation of powers and an extradition treaty with the United States.<\/p>\n<p>Even if the Canadian government thought there was a political element to the extradition request it received from Washington, it&#8217;s a matter for the courts there to decide whether her alleged activities might potentially constitute a crime in both jurisdictions &#8211; and they&#8217;ve decided yes, so the matter will proceed.<\/p>\n<p>No such separation of powers headache in China, though.
