{"id":16346,"date":"2020-01-07T05:31:40","date_gmt":"2020-01-07T10:31:40","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=16346"},"modified":"2020-01-07T05:35:45","modified_gmt":"2020-01-07T10:35:45","slug":"ikea-to-pay-family-46m-after-child-killed-by-falling-drawers","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2020\/01\/07\/ikea-to-pay-family-46m-after-child-killed-by-falling-drawers\/","title":{"rendered":"Ikea to pay family $46m after child killed by falling drawers"},"content":{"rendered":"<p class=\"story-body__introduction\">The Swedish furniture giant Ikea has agreed to pay $46m (\u00a335m) to the parents of a child who was killed when a chest of drawers fell on him.<\/p>\n<p>Jozef Dudek, 2, suffocated in May 2017 when the company&#8217;s Malm drawers toppled over at the family&#8217;s California home.<\/p>\n<p>The item, which weighs 70lbs (32kg), had been recalled a year earlier over safety concerns after three other children were killed.<\/p>\n<p>It is the largest child wrongful death settlement in US history, lawyers say.<\/p>\n<p>&#8220;While no settlement can alter the tragic events that brought us here, for the sake of the family and all involved, we&#8217;re grateful that this litigation has reached a resolution,&#8221; a spokeswoman for Ikea said.<\/p>\n<p>&#8220;We remain committed to working&#8230; to address this very important home safety issue,&#8221; she added.<\/p>\n<p>In a statement, the child&#8217;s parents, Joleen and Craig Dudek, said they were &#8220;devastated&#8221; by the loss of their son.<\/p>\n<p>&#8220;We never thought that a two-year-old could cause a dresser just 30 inches (76cm) high to topple over and suffocate him,&#8221; they said. &#8220;It was only later that we learned that [it] was unstable by design.&#8221;<\/p>\n<p>&#8220;We are telling our story because we do not want this to happen to another family,&#8221; the couple added. They urged anyone who still has a recalled Ikea dresser to return it.<\/p>\n<p>The family also said they would donate $1m of the settlement to groups working to protect children from dangerous products.<\/p>\n<p><a class=\"story-body__link-external\" href=\"https:\/\/www.ikea.com\/us\/en\/customer-service\/product-support\/recalls\/following-an-additional-child-fatality-ikea-recalls-29-million-malm-and-other-models-of-chests-pub4128a7af\" target=\"_blank\" rel=\"noopener noreferrer\">In 2016, Ikea recalled millions of Malm chests of drawers<\/a>\u00a0in North America over safety concerns. It was the largest recall in the company&#8217;s history.<\/p>\n<p>Initially, the company warned customers to use wall mounts with them but the death of a third child prompted the action.<\/p>\n<figure class=\"media-landscape has-caption full-width\"><span class=\"image-and-copyright-container\"><img loading=\"lazy\" decoding=\"async\" class=\"responsive-image__img js-image-replace\" src=\"https:\/\/ichef.bbci.co.uk\/news\/624\/cpsprodpb\/977B\/production\/_93097783_download.jpg\" alt=\"Camden Ellis, Curren Collas and Ted McGee were killed by falling dressers\" width=\"976\" height=\"549\" data-highest-encountered-width=\"624\" \/><\/span><figcaption class=\"media-caption\"><span class=\"media-caption__text\">Left to right: Camden Ellis, Curren Collas and Ted McGee were killed by falling Ikea dressers (Image: Feldman Shepherd)<\/span><\/figcaption><\/figure>\n<p>&nbsp;<\/p>\n<p>Camden Ellis, 2, Curren Collas, 2, and 23-month-old Ted McGee were all crushed by the product.<\/p>\n<p>In December of that year, the company agreed to pay $50m (\u00a340m) in a combined settlement to the families of the three toddlers.<\/p>\n<p>Under that settlement, Ikea agreed to only sell chests in the US that meet or exceed the national voluntary safety standard for clothing storage units.<\/p>\n<p>The deaths prompted the US Consumer Product Safety Commission to launch an education campaign about the risk of falling chests of drawers.<\/p>\n<p><a class=\"story-body__link\" href=\"https:\/\/www.bbc.co.uk\/news\/business-42070606\" target=\"_blank\" rel=\"noopener noreferrer\">In 2017, the company re-launched the recall<\/a>\u00a0in the US and Canada.
