{"id":15952,"date":"2019-11-09T04:11:18","date_gmt":"2019-11-09T09:11:18","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=15952"},"modified":"2019-11-09T04:11:18","modified_gmt":"2019-11-09T09:11:18","slug":"killer-claims-his-life-sentence-is-served-because-he-briefly-died","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2019\/11\/09\/killer-claims-his-life-sentence-is-served-because-he-briefly-died\/","title":{"rendered":"Killer claims his life sentence is served because he briefly died"},"content":{"rendered":"<p class=\"story-body__introduction\">A court in the US has refused to release a convict who argued that he had completed his life sentence when he briefly &#8220;died&#8221;.<\/p>\n<p>Benjamin Schreiber, 66, was sentenced to life without parole in Iowa for bludgeoning a man to death in 1996.<\/p>\n<p>He said his sentence ended when his heart stopped during a medical emergency four years ago, even though he was revived.<\/p>\n<p>But judges said Schreiber&#8217;s bid &#8211; while original &#8211; was &#8220;unpersuasive&#8221;.<\/p>\n<p>They said that it was &#8220;unlikely&#8221; to be dead, as he had signed his own legal documents in the case.<\/p>\n<div class=\"story-body\">\n<div class=\"story-body__inner\">\n<p>In 2015, Schreiber developed septic poisoning as a result of kidney stones. He had to be resuscitated by doctors in hospital, but fully recovered and was returned to prison.<\/p>\n<p>In Schreiber&#8217;s claim, filed last year, he said that he had been resuscitated against his will, and that his brief &#8220;death&#8221; meant that his life sentence had technically ended.<\/p>\n<p>The district court ruled against Schreiber &#8211; a decisions his lawyer took to the state&#8217;s court of appeal.<\/p>\n<p>On Wednesday, the appeals court upheld the lower court&#8217;s ruling.
