{"id":14771,"date":"2019-05-31T14:39:54","date_gmt":"2019-05-31T18:39:54","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=14771"},"modified":"2019-05-31T14:39:54","modified_gmt":"2019-05-31T18:39:54","slug":"navy-seal-accused-of-war-crimes-wins-release","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2019\/05\/31\/navy-seal-accused-of-war-crimes-wins-release\/","title":{"rendered":"Navy Seal accused of war crimes wins release"},"content":{"rendered":"<p class=\"story-body__introduction\">A US Navy Seal accused of stabbing a teenage Islamic State fighter to death has been unexpectedly released days ahead of his trial.<\/p>\n<p>Navy Special Operations Chief Edward Gallagher, 39, is also charged with indiscriminately shooting Iraqi civilians on his eighth combat tour.<\/p>\n<p>A military judge freed the combat veteran after prosecutors acknowledged tracking the defence team&#8217;s emails.<\/p>\n<p>US President Donald Trump is reportedly mulling a pardon for Chief Gallagher.<\/p>\n<p>Thursday&#8217;s surprise ruling by the judge, Capt Aaron Rugh, drew gasps in the San Diego court, according to the Associated Press news agency.<\/p>\n<p>Chief Gallagher&#8217;s defence team is arguing the case should be dismissed or prosecutors removed as a result of what they called illegal spying.<\/p>\n<p>The highly decorated sniper and medic is scheduled to stand trial on 10 June for nearly a dozen alleged crimes.<\/p>\n<p>He has pleaded not guilty to murdering an injured teenage militant in Iraq in 2017 and attempted murder for shooting civilians from a sniper&#8217;s nest.<\/p>\n<p>In court, lawyers for Chief Gallagher presented evidence that Navy prosecutors and their investigators had embedded a tracking code in emails sent to defence attorneys and a journalist with the Navy Times who had broken several stories on the case based on leaked documents.<\/p>\n<p>Defence attorney Tim Parlatore described a &#8220;rogue, relentless and unlawful cyber-campaign&#8221; that he argued had violated attorney-client privilege and undermined Chief Gallagher&#8217;s right to a fair trial,\u00a0<a class=\"story-body__link-external\" href=\"https:\/\/apnews.com\/7fee0f71e7ad41dd81dd1776f24bdf10?utm_medium=APWestRegion&amp;utm_campaign=SocialFlow&amp;utm_source=Twitter\" target=\"_blank\" rel=\"noopener noreferrer\">according to the Associated Press<\/a>.<\/p>\n<p>The lead prosecutor, Cmdr Christopher Czaplak, said the code only showed where and when recipients opened the emails.<\/p>\n<p>Leaving court with her husband on Thursday, Andrea Gallagher spoke briefly with reporters saying: &#8220;We have been utterly terrorised by this entire farce of a case.&#8221;<\/p>\n<p>Mrs Gallagher has called the trial &#8220;an atrocity committed against America&#8217;s service members&#8221; and frequently posts updates on the Free Eddie Gallagher Facebook page.<\/p>\n<p>Chief Gallagher was held in pre-trial confinement after prosecutors accused him of contacting witnesses.<\/p>\n<p>His case has drawn widespread attention, including from President Trump.<\/p>\n<p>At the end of March, Mr Trump personally intervened in the case, demanding that Chief Gallagher be moved from a military prison to a less-restrictive facility.<\/p>\n<div class=\"social-embed\">\n<div class=\"social-embed-post social-embed-fallbacktwitter embed-image-wrap\">\n<figure class=\"media-landscape full-width embed-screenshot-js\"><a class=\"embed-original-post-link\" href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/1111965027483951105\"><span class=\"image-and-copyright-container\"><img loading=\"lazy\" decoding=\"async\" class=\"responsive-image__img js-image-replace\" src=\"https:\/\/ichef.bbci.co.uk\/news\/485\/socialembed\/https:\/\/twitter.com\/realDonaldTrump\/status\/1111965027483951105~\/news\/world-us-canada-48478348\" alt=\"Twitter post by @realDonaldTrump: In honor of his past service to our Country, Navy Seal #EddieGallagher will soon be moved to less restrictive confinement while he awaits his day in court.
