{"id":14381,"date":"2019-04-10T05:04:03","date_gmt":"2019-04-10T09:04:03","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=14381"},"modified":"2019-04-10T05:04:03","modified_gmt":"2019-04-10T09:04:03","slug":"trump-court-defeat-on-asylum-policy-unfair-to-us","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2019\/04\/10\/trump-court-defeat-on-asylum-policy-unfair-to-us\/","title":{"rendered":"Trump: Court defeat on asylum policy &#8216;unfair to US&#8217;"},"content":{"rendered":"<p class=\"story-body__introduction\">US President Donald Trump has lashed out at a judge for blocking his policy of sending asylum seekers to Mexico to await court hearings in their cases.<\/p>\n<p>&#8220;A 9th Circuit judge just ruled that Mexico is too dangerous for migrants,&#8221; he tweeted. &#8220;So unfair to the US.&#8221;<\/p>\n<p>His policy would have returned migrants back over the border while they sought a legal right to stay in the US.<\/p>\n<p>The legal defeat comes as migrant numbers at the US-Mexico border surged to their highest since 2008.<\/p>\n<p>Mr Trump was said to be livid after US immigration officials estimated border apprehensions in March had topped 100,000.<\/p>\n<p>The San Francisco ninth district judge&#8217;s order on Monday against the migrant policy is not due to go into effect until this Friday.<\/p>\n<p>The White House said in a statement on Tuesday it would appeal the decision.<\/p>\n<p>&#8220;This action gravely undermines the president&#8217;s ability to address the crisis at the border with the tools Congress has authorised and disrupts the conduct of our foreign affairs,&#8221; the White House said in a statement.<\/p>\n<p>&#8220;We intend to appeal, and we will take all necessary action to defend the executive branch&#8217;s lawful efforts to resolve the crisis at our southern border.&#8221;<\/p>\n<div class=\"social-embed\">\n<div class=\"social-embed-post social-embed-fallbacktwitter embed-image-wrap\">\n<figure class=\"media-landscape full-width embed-screenshot-js\"><a class=\"embed-original-post-link\" href=\"https:\/\/twitter.com\/realDonaldTrump\/status\/1115451908213411845\"><span class=\"image-and-copyright-container\"><img loading=\"lazy\" decoding=\"async\" class=\"responsive-image__img js-image-replace\" src=\"https:\/\/ichef.bbci.co.uk\/news\/485\/socialembed\/https:\/\/twitter.com\/realDonaldTrump\/status\/1115451908213411845~\/news\/world-us-canada-47869821\" alt=\"Twitter post by @realDonaldTrump: A 9th Circuit Judge just ruled that Mexico is too dangerous for migrants. So unfair to the U.S. OUT OF CONTROL! \" width=\"465\" height=\"342\" data-highest-encountered-width=\"485\" \/><\/span><\/a><\/figure>\n<\/div>\n<\/div>\n<figure class=\"media-landscape no-caption full-width\"><span class=\"image-and-copyright-container\"><img loading=\"lazy\" decoding=\"async\" class=\"responsive-image__img js-image-replace\" src=\"https:\/\/ichef.bbci.co.uk\/news\/624\/cpsprodpb\/17B75\/production\/_105914179_blank_white_space-nc.png\" alt=\"Presentational white space\" width=\"624\" height=\"1\" data-highest-encountered-width=\"624\" \/><\/span><\/figure>\n<p>Meanwhile, the Department of Homeland Security (DHS), which implements Mr Trump&#8217;s immigration directives, is in turmoil following a major shake-up.<\/p>\n<p>DHS Secretary Kirstjen Nielsen quit on Sunday after being summoned to the White House by the president.<\/p>\n<p>This was followed by the resignation of the agency&#8217;s acting deputy secretary, Claire Grady, on Wednesday. Ms Grady was legally supposed to take over from Ms Nielsen.<\/p>\n<p>Republican Senator Chuck Grassley called on Mr Trump on Monday to halt the leadership purge at the DHS.<\/p>\n<p>The senior senator\u00a0<a class=\"story-body__link-external\" href=\"https:\/\/www.washingtonpost.com\/politics\/grassley-warns-white-house-not-to-oust-any-more-top-immigration-officials\/2019\/04\/08\/0b896e26-5a55-11e9-b8e3-b03311fbbbfe_story.html?utm_term=.084c81ca527a\" target=\"_blank\" rel=\"noopener noreferrer\">told the Washington Post<\/a>\u00a0he was &#8220;very, very concerned&#8221; about reports of possible further dismissals.<\/p>\n<p>&#8220;The president has to have some stability and particularly with the number one issue that he&#8217;s made for his campaign,&#8221; Mr Grassley said.<\/p>\n<p>&#8220;He&#8217;s pulling the rug out from the very people that are trying to help him accomplish his goal.&#8221;<\/p>\n<p>Last week Mr Trump rescinded his own nomination of Ronald Vitiello as director of Immigration and Customs Enforcement (ICE).<\/p>\n<p>Speaking to Fox News on Monday, White House spokesman Hogan Gidley said: &#8220;It&#8217;s time to do things a little differently.<\/p>\n<p>&#8220;The president&#8217;s looking around to reshape his team so he can have the people in place to carry out his agenda.&#8221;<\/p>\n<p>There are also reports that the president is preparing to toughen his stance on immigration.<\/p>\n<p><a class=\"story-body__link-external\" href=\"https:\/\/www.nytimes.com\/2019\/04\/08\/us\/politics\/trump-asylum-seekers-federal-judge.html\" target=\"_blank\" rel=\"noopener noreferrer\">According to the New York Times<\/a>, Mr Trump is considering implementing further limits on asylum seekers, ending birthright citizenship, and closing ports of entry at the Mexican border.<\/p>\n<p>But Mr Trump denied on Tuesday reports that his administration was planning once again to separate families caught crossing the border.<\/p>\n<p>&#8220;We are not looking to do it,&#8221; he said.<\/p>\n<p>He added: &#8220;Once you don&#8217;t have it [child separation], that&#8217;s why you see many more people coming. They&#8217;re coming like it&#8217;s a picnic because let&#8217;s go to Disneyland.&#8221;<\/p>\n<p>More than 2,700 immigrant children were separated from their parents last year under a so-called zero tolerance US policy to prosecute anyone caught crossing the border illegally.<\/p>\n<p>According to US media, the White House has recently been considering a &#8220;binary choice&#8221; policy.<\/p>\n<p>This would give migrant parents awaiting immigration hearings two options: agree for their child to be held separately, or be detained together, possibly indefinitely, until their court date.<\/p>\n<p>A 1997 court decision known as the Flores agreement states that immigrant children are only allowed to be held for 20 days.<\/p>\n<p>The Trump administration has reportedly drafted a regulation to change these rules,\u00a0<a class=\"story-body__link-external\" href=\"https:\/\/www.axios.com\/donald-trump-border-security-immigration-plan-3659270b-18f9-4d32-b0ff-2dd9a5c9b59e.html\" target=\"_blank\" rel=\"noopener noreferrer\">an official told the Axios news website<\/a>, so that the government could detain children for longer periods of time.<\/p>\n<p>Senior White House adviser Stephen Miller is said to be encouraging the president to adopt an increasingly hardline stance on immigration.<\/p>\n<p>Democratic congresswoman Ilhan Omar on Monday called Mr Miller &#8220;a white nationalist&#8221; on Twitter.<\/p>\n<div class=\"social-embed\">\n<div class=\"social-embed-post social-embed-fallbacktwitter embed-image-wrap\">\n<figure class=\"media-landscape full-width embed-screenshot-js\"><a class=\"embed-original-post-link\" href=\"https:\/\/twitter.com\/IlhanMN\/status\/1115352166179508224\"><span class=\"image-and-copyright-container\"><img loading=\"lazy\" decoding=\"async\" class=\"responsive-image__img js-image-replace\" src=\"https:\/\/ichef.bbci.co.uk\/news\/485\/socialembed\/https:\/\/twitter.com\/IlhanMN\/status\/1115352166179508224~\/news\/world-us-canada-47869821\" alt=\"Twitter post by @IlhanMN: Stephen Miller is a white nationalist.
