{"id":14236,"date":"2019-03-26T05:26:17","date_gmt":"2019-03-26T09:26:17","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=14236"},"modified":"2019-03-26T05:26:17","modified_gmt":"2019-03-26T09:26:17","slug":"michael-avenatti-stormy-daniels-ex-lawyer-accused-of-fraud","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2019\/03\/26\/michael-avenatti-stormy-daniels-ex-lawyer-accused-of-fraud\/","title":{"rendered":"Michael Avenatti: Stormy Daniels ex-lawyer accused of fraud"},"content":{"rendered":"<p class=\"story-body__introduction\">US lawyer Michael Avenatti, who represented porn star Stormy Daniels in her lawsuit against President Trump, has been arrested on fraud charges.<\/p>\n<p>Prosecutors say he tried to extort more than $20m (\u00a315m) from Nike, threatening to use his profile to inflict reputational harm on the firm.<\/p>\n<p>In a separate case, the 48-year-old has been accused of embezzlement.<\/p>\n<p>A frequent guest on TV news and talk shows, Mr Avenatti emerged as a fierce critic of Donald Trump.<\/p>\n<p>At one point he said he was considering running for president himself in 2020.<\/p>\n<p>Mr Avenatti appeared in a New York court on Monday and was released on $300,000 (\u00a3227,000) bail on condition that he surrender his US and Italian passports. He did not enter a plea.<\/p>\n<p>Outside court, he said he was confident he would be &#8220;fully exonerated&#8221;.<\/p>\n<p>He told reporters he had spent his career fighting powerful people and powerful corporations and that he would &#8220;never stop fighting that good fight&#8221;.<\/p>\n<h2 class=\"story-body__crosshead\">What are the Nike charges about?<\/h2>\n<p><a class=\"story-body__link-external\" href=\"https:\/\/www.documentcloud.org\/documents\/5780145-U-S-v-Michael-Avenatti-Complaint.html\" target=\"_blank\" rel=\"noopener noreferrer\">According to federal prosecutors in New York<\/a>, Mr Avenatti met a lawyer for Nike earlier this month. During their meeting, he allegedly threatened to release damaging information about the company unless it paid him and another, unnamed co-conspirator between $15m (\u00a311.4m) and $25m (\u00a319m).<\/p>\n<p>He also demanded $1.5m (\u00a31.13m) for an individual he claimed to represent.<\/p>\n<p>Mr Avenatti reportedly threatened to take $10bn (\u00a37.56bn) off Nike&#8217;s market value.<\/p>\n<p>He was arrested in New York on Monday, shortly after announcing that he would hold a news conference about a scandal surrounding Nike on Tuesday.<\/p>\n<div class=\"social-embed\">\n<div class=\"social-embed-post social-embed-fallbacktwitter embed-image-wrap\">\n<figure class=\"media-landscape full-width embed-screenshot-js\"><a class=\"embed-original-post-link\" href=\"https:\/\/twitter.com\/MichaelAvenatti\/status\/1110213957170749440\"><span class=\"image-and-copyright-container\"><img loading=\"lazy\" decoding=\"async\" class=\"responsive-image__img js-image-replace\" src=\"https:\/\/ichef.bbci.co.uk\/news\/485\/socialembed\/https:\/\/twitter.com\/MichaelAvenatti\/status\/1110213957170749440~\/news\/world-us-canada-47699802\" alt=\"Twitter post by @MichaelAvenatti: Tmrw at 11 am ET, we will be holding a press conference to disclose a major high school\/college basketball scandal perpetrated by @Nike that we have uncovered. This criminal conduct reaches the highest levels of Nike and involves some of the biggest names in college basketball.\" width=\"465\" height=\"272\" data-highest-encountered-width=\"485\" \/><\/span><\/a><\/figure>\n<\/div>\n<\/div>\n<p>&#8220;A suit and tie does not mask the fact that, at its core, this was an old-fashioned shakedown,&#8221; said prosecutor Geoffrey Berman told reporters.<\/p>\n<p>Nike said in a statement it would &#8220;not be extorted or hide information that is relevant to a government investigation&#8221;.<\/p>\n<p>The company said it immediately reported the matter to federal prosecutors.<\/p>\n<h2 class=\"story-body__crosshead\">What other charges is Avenatti facing?<\/h2>\n<p>In another case in Los Angeles, Mr Avenatti\u00a0<a class=\"story-body__link-external\" href=\"https:\/\/www.scribd.com\/document\/403089343\/Avenatti-Complaint\" target=\"_blank\" rel=\"noopener noreferrer\">has been charged<\/a>\u00a0with embezzling money from a client and defrauding a bank.<\/p>\n<p>Los Angeles prosecutor Nick Hanna said Mr Avenatti describes himself as an &#8220;attorney, advocate and fighter for good&#8221; on social media, while in fact he &#8220;fights for his own selfish interests&#8221;.<\/p>\n<p>Prosecutors say that he negotiated a $1.6m settlement for a client, but only gave them a &#8220;bogus&#8221; agreement with a false payment date.<\/p>\n<p>He allegedly then collected the settlement in secret and &#8220;advanced&#8221; $130,000 to his client, using the rest to support his &#8220;lavish lifestyle&#8221;.<\/p>\n<p>Mr Avenatti is also accused of falsifying documents to secure a loan from a Mississippi bank.<\/p>\n<p>He is due to appear in court in California on 1 April and in New York on 25 April.<\/p>\n<h2 class=\"story-body__crosshead\">What about Stormy Daniels?<\/h2>\n<p>Mr Avenatti has formerly represented Stormy Daniels, who is suing the president to get out of a non-disclosure agreement she signed before the 2016 election. The non-disclosure agreement related to an affair she said he had with Mr Trump in 2006.<\/p>\n<p>On Saturday,\u00a0<a class=\"story-body__link-external\" href=\"https:\/\/twitter.com\/MichaelAvenatti\/status\/1109918732044763136\" target=\"_blank\" rel=\"noopener noreferrer\">he tweeted<\/a>\u00a0that the president should be indicted for colluding with his former lawyer &#8220;to violate the law and commit crimes.&#8221;<\/p>\n<p>Ms Daniels,\u00a0<a class=\"story-body__link-external\" href=\"https:\/\/twitter.com\/StormyDaniels\/status\/1110240069619572738\" target=\"_blank\" rel=\"noopener noreferrer\">in a tweet<\/a>, said on Monday that she had terminated Mr Avenatti&#8217;s contract &#8220;more than a month ago&#8230; after discovering that he had dealt with me extremely dishonestly&#8221;.<\/p>\n<p>&#8220;Knowing what I know now about Michael, I&#8217;m saddened but not shocked regarding his arrest.&#8221;<\/p>\n<p>Source: <a href=\"https:\/\/www.bbc.co.uk\/news\/world-us-canada-47699802\" target=\"_blank\" rel=\"noopener noreferrer\">bbc.co.uk<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">US lawyer Michael Avenatti, who represented porn star Stormy Daniels in her lawsuit against President Trump, has been arrested on fraud charges.
