{"id":13659,"date":"2019-01-23T18:39:38","date_gmt":"2019-01-23T23:39:38","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=13659"},"modified":"2019-01-23T18:39:38","modified_gmt":"2019-01-23T23:39:38","slug":"council-wins-muslim-graves-high-court-battle","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2019\/01\/23\/council-wins-muslim-graves-high-court-battle\/","title":{"rendered":"Council wins Muslim graves High Court battle"},"content":{"rendered":"<p class=\"story-body__introduction\">A Muslim man who said his human rights were breached by a council&#8217;s refusal to permit a marble edge around a grave has lost a High Court battle.<\/p>\n<p>Atta Ul-Haq was refused permission to install the barrier on his father&#8217;s grave at Streetly Cemetery in Walsall.<\/p>\n<p>He said his religion as a Barelvi Muslim forbade people walking over graves, but the council said its response was &#8220;sensitive&#8221;.<\/p>\n<p>Mr Ul-Haq&#8217;s solicitor has said he plans to appeal the ruling.<\/p>\n<figure class=\"media-landscape has-caption full-width\"><span class=\"image-and-copyright-container\"><img loading=\"lazy\" decoding=\"async\" class=\"responsive-image__img js-image-replace\" src=\"https:\/\/ichef.bbci.co.uk\/news\/624\/cpsprodpb\/385D\/production\/_105292441_walsall.jpg\" alt=\"Muslim protestors in Walsall in August 2016\" width=\"976\" height=\"549\" data-highest-encountered-width=\"624\" \/><\/span><figcaption class=\"media-caption\"><span class=\"media-caption__text\">Muslim protestors gathered outside Walsall council in August 2016 to challenge their policy at Streetly Cemetery<\/span><\/figcaption><\/figure>\n<p>&nbsp;<\/p>\n<p>Mr Ul-Haq had argued the council&#8217;s refusal to allow him to erect the 4in (10cm) raised edge breached his right to exercise his religion, as is enshrined in Article 9 of the European Convention on Human Rights.<\/p>\n<p>Walsall Metropolitan Borough Council defended itself by saying it permitted &#8220;mounding of the graves&#8221; at the cemetery and that this is how Muslims normally inhibit people walking over them.<\/p>\n<p>It also said it could not accommodate Mr Ul-Haq&#8217;s wishes without harming the rights of other Muslims.<\/p>\n<p><a class=\"story-body__link\" href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-birmingham-46458946\" target=\"_blank\" rel=\"noopener\">High Court judges heard both arguments in December<\/a>\u00a0and returned their ruling today, dismissing Mr Ul-Haq&#8217;s challenge.<\/p>\n<p>They concluded that council bosses had &#8220;acted in a way which is justified&#8221; and said what council had decided fell within their &#8220;margin of judgment&#8221;.<\/p>\n<p>Mr Ul-Haq&#8217;s solicitor, Natalia Garcia, said he intends to take his case to the court of appeal.<\/p>\n<p>She said the case is of &#8220;significant wider public interest to the Muslim community&#8221;.<\/p>\n<p>Mehboob Matloob, who organised a protest outside Walsall Council in August 2016, said he was &#8220;very disappointed&#8221; with the ruling.<\/p>\n<p>Mr Matloob&#8217;s brother is also buried in Streetly cemetery, and he said the ledges on his grave had been damaged.<\/p>\n<p>&#8220;I can&#8217;t see how they can justify it,&#8221; he said.<\/p>\n<p>The council said it was &#8220;pleased&#8221; with the ruling, saying its cemetery rules &#8220;do not discriminate against any individual or community and are appropriate and fair.&#8221;<\/p>\n<p>Source: <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-england-birmingham-46958597\" target=\"_blank\" rel=\"noopener\">bbc.co.uk<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">A Muslim man who said his human rights were breached by a council&#8217;s refusal to permit a marble edge around a grave has lost a High Court battle.
