Although YouTube took the movie offline when it was reported, the producer wants the video service to take responsibility.<\/p>\n<p>On an average day, roughly half a million hours of video are uploaded to YouTube.<\/p>\n<p>As with any user-generated content site, this also includes pirated works, including full-length films.<\/p>\n<p>This is not a new problem and YouTube does its best to remove infringing videos and accounts when they\u2019re reported. However, Dutch film production company \u2018<a href=\"http:\/\/farmhousefilm.com\/library\" target=\"_blank\" rel=\"noopener\">Farmhouse TV &amp; Film<\/a>\u00a0says that it\u2019s not enough.<\/p>\n<p>The company produced the film \u201c<a href=\"https:\/\/www.imdb.com\/title\/tt6155374\/\" target=\"_blank\" rel=\"noopener\">Redbad<\/a>\u201d which premiered locally this summer. With one of the largest ever budgets for a Dutch film, it didn\u2019t provide the success the makers had hoped for.<\/p>\n<p>During the first month, it recouped\u00a0<a href=\"https:\/\/en.wikipedia.org\/wiki\/Redbad_(film)#Box_office\" target=\"_blank\" rel=\"noopener\">less than \u20ac400,000<\/a>\u00a0of the \u20ac8 million budget, making it one of the\u00a0<a href=\"https:\/\/www.ad.nl\/show\/redbad-grootste-flop-br-ooit-in-nederland~afd0fa7c\/\" target=\"_blank\" rel=\"noopener\">biggest flops<\/a>\u00a0in Dutch theaters.<\/p>\n<p>While the film failed to draw the masses to the big screen, it did much better on YouTube. According to Farmhouse TV &amp; Film, a full copy of the movie reached half a million views after it was uploaded. The only problem is that this copy wasn\u2019t authorized.<\/p>\n<p>The production company isn\u2019t happy with this unlicensed consumption and is now demanding \u20ac200,000 in compensation. Producer Klaas de Jong states that YouTube should take responsibility, noting that the pirated copy was displaying advertisements as well.<\/p>\n<p>\u201cThis way, YouTube has created a revenue model out of the illegal distribution of content,\u201d De Jong says,\u00a0<a href=\"https:\/\/www.nu.nl\/film\/5600708\/producent-redbad-eist-2-ton-van-videoplatform-youtube.html#coral_talk_wrapper\" target=\"_blank\" rel=\"noopener\">quoted<\/a>\u00a0by Nu.nl.<\/p>\n<p>\u201cEnough is enough. We\u2019re talking about an illegal and criminal offense, and YouTube is not taking responsibility,\u201d he adds.<\/p>\n<p>YouTube hasn\u2019t commented on this individual case. However, the company explains that rightsholders can ask the video platform to take an infringing copy offline. This is what happened with the pirated copy of Redbad.<\/p>\n<p>The producer believes that this is irrelevant. The harm was already done when they spotted the copy and the takedown system has its limitations, especially when infringing content swiftly reappears.<\/p>\n<p>\u201cThis leads to a situation in which we as producers have to check for illegal links to our films on YouTube every week and beg to have them removed, after which they immediately reappear through another channel,\u201d De Jong says.<\/p>\n<p>Tim Kuik, director of the local anti-piracy outfit BREIN which isn\u2019t involved in the matter, says that it\u2019s the first time a Dutch producer takes this step. Kuik also notes that the availability of pirated films on YouTube is a known problem.<\/p>\n<p>In the present matter, it\u2019s unlikely that Farmhouse TV &amp; Film will get anything from YouTube without going to court. Previously, Austrian television channel Puls 4 did just that, with success.<\/p>\n<p>This summer a court in Vienna\u00a0<a href=\"https:\/\/torrentfreak.com\/youtube-can-be-liable-for-copyright-infringing-videos-court-rules-180607\/\" target=\"_blank\" rel=\"noopener\">concluded<\/a>\u00a0that YouTube can indeed be held directly liable for users\u2019 copyright infringements. The video service is not a neutral intermediary and should do more to prevent infringing uploads, the court ruled. The verdict in question is not yet final.<\/p>\n<p>Ideally, Farmhouse TV &amp; Film and other rightsholders would like YouTube to start filtering all content proactively. That sounds a lot like the EU\u2019s Article 13 proposal, which\u00a0<a href=\"https:\/\/torrentfreak.com\/youtube-amps-up-article-13-protest-with-pop-ups-181121\/\" target=\"_blank\" rel=\"noopener\">YouTube is currently campaigning against<\/a>.<\/p>\n<p>Interestingly, the production company was also tied up in another YouTube brawl earlier this year.
