{"id":10411,"date":"2018-01-29T04:43:44","date_gmt":"2018-01-29T09:43:44","guid":{"rendered":"http:\/\/worldjusticenews.com\/news\/?p=10411"},"modified":"2018-01-29T04:44:29","modified_gmt":"2018-01-29T09:44:29","slug":"mistrial-declared-murder-trial-evan-polchies","status":"publish","type":"post","link":"https:\/\/worldjusticenews.com\/news\/2018\/01\/29\/mistrial-declared-murder-trial-evan-polchies\/","title":{"rendered":"Mistrial declared in murder trial of Evan Polchies"},"content":{"rendered":"<p>Justice Judy Clendening declared a mistrial in the second-degree murder trial of Evan Polchies\u00a0after the jury was\u00a0 a not able to come to a unanimous decision on a verdict.<\/p>\n<p>The decision came on Sunday morning after more than\u00a0four days of deliberations\u00a0and nine days of testimony.<\/p>\n<p>Polchies\u00a0was on trial in the shooting death of Bobby Martin Jr.<\/p>\n<p>It was not disputed that Bobby Martin Jr. died in hospital after being\u00a0shot twice by Evan Polchies\u00a0at the Tamarack Estates mini-home park in Lincoln, near Fredericton. The jury had to decide whether Evan Polchies\u00a0meant to kill Bobby Martin Jr. or had used the kind of force he knew would kill him when he shot him in the early hours of\u00a0Jan. 26, 2017.<\/p>\n<p>The defence argued Polchies\u00a0acted in self-defence, alleging Martin attacked Polchies at the Tamarack Estates mini-home.<\/p>\n<p>Polchies co-accused Joe-Anna Hachey (whose trial is in April) testified during the trial that she and Polchies lured Martin to the Tamarack Estates residence with the promise of buying cocaine from him and planned to rob him.<\/p>\n<figure id=\"attachment_10412\" aria-describedby=\"caption-attachment-10412\" style=\"width: 465px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2018\/01\/Joe-Anna-Hachey.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-10412\" src=\"http:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2018\/01\/Joe-Anna-Hachey.jpg\" alt=\"Joe-Anna Hachey\" width=\"465\" height=\"262\" srcset=\"https:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2018\/01\/Joe-Anna-Hachey.jpg 465w, https:\/\/worldjusticenews.com\/news\/wp-content\/uploads\/2018\/01\/Joe-Anna-Hachey-300x169.jpg 300w\" sizes=\"auto, (max-width: 465px) 100vw, 465px\" \/><\/a><figcaption id=\"caption-attachment-10412\" class=\"wp-caption-text\">Joe-Anna Hachey, 23, of Fredericton, told the court that she and Evan Polchies planned to rob Bobby Martin Jr.<\/figcaption><\/figure>\n<p>Evan Polchies disputed the testimony of Joe-Anna Hachey. He told the court that Bobby Martin Jr. came at him with a large hunting knife, so he defended himself by firing the two shots that proved deadly.<\/p>\n<p>Polchies&#8217; lawyer, TJ Burke, said his client was &#8220;disappointed, obviously&#8221; in Sunday&#8217;s decision.<\/p>\n<p>&#8220;He wanted some conclusion to this matter, but we&#8217;re prepared to go back to trial and do it all over again,&#8221; he said.<\/p>\n<p>He added that it was unusual for a jury to take this long to deliberate.<\/p>\n<p>&#8220;I think juries in Fredericton are pretty conservative. They usually come back quickly with a decision.
